Bail plea of private company’s project manager rejected

AMRITSAR: Even as the local court today rejected the bail plea of Nishchal Tyagi the project manager of Simmro Infrastructure and Developers Private Limited who was allegedly arrested in a case related to misappropriation of raw material and machinery belonging to a Delhibased firm CCC Infrasys Private Limited the police have miserably failed to arrest the remaining two suspects in the case

Even as the local court today rejected the bail plea of Nishchal Tyagi, the project manager of Simmro Infrastructure and Developers Private Limited, who was allegedly arrested in a case related to misappropriation of raw material and machinery belonging to a Delhi-based firm, CCC Infrasys Private Limited, the police have miserably failed to arrest the remaining two suspects in the case.

The police have named the chairman and the director of the company, Balbir Singh Kakkar and Majid Akhtar, respectively, in the FIR registered under sections of theft (Section 379 of the IPC), criminal breach of trust (Section 406 of the IPC), criminal intimidation (Section 506 of the IPC) and common intention in the criminal act (Section 34 of the IPC).

The owner of the Delhi-based firm, registered as a micro small and medium enterprises unit, had alleged that their contract was illegally terminated and their payment to the tune of Rs. 3.50 crore was wrongly withheld by the accused. He had stated to the police that the alleged accused had also threatened officials of his company, barring them from entering the site besides engaging a local contractor to do the work, and had misappropriated building material and construction machinery worth over Rs 1 crore.

While conducting the probe, the police found prima facie evidence that Majid Akhtar and Nishchal Tyagi used the embezzled material and machinery at the behest of the chairman of the group, Balbir Singh Kakkar. The legal opinion sought by the police also recommended the registration of a prima facie case under all the above-mentioned sections of the Indian Penal Code (IPC) against the suspects.

The complainant alleged that the accused were using their political clout and money for delaying their arrest and were pressurising the police.
