Dealer fined for delay in vehicle registration

The district consumer disputes redressal forum has directed a car dealer to immediately hand over the original registration certificate (RC) to a person who purchased a vehicle from him. The dealer has also been directed to pay a compensation of Rs 10,000 and litigation expenses of Rs 3,000 for not delivering the RC in time.

Sahil Gupta, a resident of Rani Ka Bagh, filed a complaint against Krishna Auto Sales, stating that he purchased a car from the opposite party and paid charges for insurance, registration and permanent registration number, along with the cost of the vehicle, at the time of the purchase. He said he was issued a provisional registration number which was valid for one week. After the expiry of the period, the opposite party stated that the process of registration of RC was going on and it would take more time for completion. The complainant alleged that even after eight months of the purchase, the opposite party did not deliver the RC.

As the opposite party did not join proceedings, the forum proceeded ex parte and stated that the evidence adduced by the complainant had gone unrebutted. It added that the opposite party impliedly admitted the claim of the complainant, which further shows that the opposite party had no defence to offer for contesting the case.

The forum stated that the act of the opposite party caused mental harassment, tension and agony to the complainant as he was not able to use the vehicle due to the fear of challan by the traffic police.
