The consumer forum has ordered a motorcycle dealer to pay Rs 2,000 as compensation and refund Rs 8, which he had overcharged from a customer while selling two ball bearings. The MRP on the bearing packet was Rs 86 (Rs 172 for two bearings), but the dealer charged Rs 180 following which the consumer had filed the complaint against him.
Earlier, Gurmukh Singh, a resident of Bhai Veer Singh Colony, had filed a complaint against Speedways, a motorcycle dealer on MM Malviya Road, stating that he purchased two bearings for his motorcycle from the opposite party on June 9 this year.
He complained that the maximum retail price (MRP) mentioned on each packet of ball bearings was Rs 86 but at the time of payment the agency charged Rs 180 for the two packets. He complained that Rs 8 were charged in excess from him.
In its reply, the opposite party stated that the company had increased the price of bearings in May. As such they sold bearings on basis of the revised price. The opposite party admitted that packets had the old MRP as these were manufactured in 2014.
The forum observed that there was no denying the fact that the complainant purchased two bearings for Rs 180, whose MRP mentioned on each pack was Rs 86.
The forum stated that from perusal of the evidence on record, it becomes evident that the opposite party had indulged in gross unfair trade practice as well as deficiency in service. It further stated that the opposite party could not charge in excess of the MRP.
