Court dismisses Lalit hotel’s revision petition

A local court today dismissed the revision petition filed by the Lalit hotel in the case involving the death of a youth by falling into an exhaust shaft at the hotel.

The petition was filed against the order summoning the three directors of the hotel, under Section 397 of the CrPC. It was filed by Delhi residents — Madhav Sikka, Arvind Sachdev and Rocky Kalra. The accused had claimed that after investigating the matter, the police had not found any violation on the part of the hotel management. Also, architect Anchal Kataria had already been chargesheeted for negligence.

The petition mentioned that as per the CCTV footage, victim Mani Singla was using his mobile phone and thus the incident took place due to the negligence of the deceased and not the hotel management.

It also stated that the trial court had committed an error by issuing summons to the hotel authorities. Defense Counsel Dikshit Arora maintains that it was complete negligence on the part of the hotel. He also mentioned that the case is based on the UT chief architect’s report which says that safety is the responsibility of the hotel.

On March 20, 2014, deceased Mani Singla had gone to the hotel to attend a function. However, Mani fell into an exhaust shaft. Mani was taken to the GMCH-32 where he was declared brought dead.

On the complaint of the deceased’s father, a case was registered against the hotel staff. Later, the police filed a challan in court against a private architect Anchal Kataria. The family of the deceased had then asked that the directors of the hotel also be made a party in the case.

The case
