A local court framed charges against four residents of Sector 38 in a cheating case on Tuesday.

The accused have been identified as Ajay Nagpal, his wife Monica Nagpal, Harbant Singh Bajwa and Raj Paul under Section 420 (cheating and dishonestly inducing delivery of property) and 120B (criminal conspiracy) of the Indian Penal Code (IPC).

They were arrested by the Economic Offences Wing of the Chandigarh Police on June 2 on a complaint of Dimple Garg, also a resident of Sector 38, who accused the four of being involved in a fraud in the sale of a house in Sector 37-D.

Garg said she and her husband Vinod Kumar had contacted Ajay Nagpal to ask for the refund of money taken by him on the pretext of selling the said property on the basis of a memorandum of understanding (MoU) in October, 2013.

She said he did not return the money and the couple never received an NOC (No Objection Certificate) from the estate office. Dimple had then learnt that Raj Paul was not the owner of the property. She alleged that the accused had shown certain documents to her and her husband regarding the MoU and sale agreement between Ajay Nagapal and Raj Paul after which Garg made Rs 20 lakh and Rs 4 lakh payment on October 5 and October 16, respectively.

However, during the process of sale of the property, Ajay Nagpal had told Garg that the said house was initially sold to another Nirmal Kumar Gupta in December, 2008, and a dispute was on in a local court regarding the deal.

Nagpal promised the complainant to settle all issues and that he would obtain an NOC from the estate office. However, even the estate office had filed a complaint with the SSP, Chandigarh, in 2015. Garg had made a payment amounting to Rs 1 lakh in cash, Rs 25 lakh vide a draft in 2013, she alleged that she and her husband had been cheated.
