The Haryana Real Estate Regulatory Authority (HRERA), Panchkula, has issued a show-cause notice to directors of Ansal Properties and Infrastructure Ltd asking them as to why they shall not be sentenced to civil imprisonment for the non-execution of refund for failing to deliver a plot to a customer within the agreed time, as per its earlier order.
The authority also directed them to appear before personally before the tribunal on account of non-compliance with the orders.
The real estate tribunal said: “Directors of the company have not even bothered to comply with the orders or appear before the authority to explain reasons thereof. Hence, the authority is convinced that there is wilful defiance on the part of directors of the respondent company.”
Neelu Sardana, the complainant, had approached the HRERA through counsel Himanshu Raj for not giving the possession of a plot within the stipulated time.
In its earlier order, the HRERA had directed the real estate company to refund the amount paid by the customer, along with interest at the rate of 9 per cent per annum, within 45 days.
But the company didn’t comply with the order even after a year following which, the execution petition was filed by the complainant.
October 30 is the date for next hearing.
