Khaitan Electricals fined for selling damaged exhaust fan

The District Consumer Disputes Redressal Forum has imposed a fine of Rs 2,200 on Khaitan Electricals Limited and Khaitan Freshair Fan Quality Industries for selling a damaged product to a Zirakpur resident.
The forum has also directed the respondents to refund Rs 1,100, the cost of the faulty exhaust fan, along with nine per cent interest, to the complainant, Sushma of Peermuchalla in Zirakpur.
In her complaint to the forum, the Sushma had stated that she had purchased an exhaust fan from Jindal Crockery Store in Sector 10 on November 14, 2017. She said an employee of the store had checked the fan before giving it to her. She said she paid Rs 1,050 for the fan. She reached home and opened the pack only to find the plastic cover of the fan damaged. She checked further and found the fan damaged too.
The complainant said she immediately went to the shop and asked the shopkeeper to replace the product but in vain. She later sent a legal notice to the shopkeeper. As the notice too proved futile, she approached the consumer forum.
The forum, with Sat Pal as its president and Dr Pawan Kumar Saini and Dr Sushma Garg as members, dismissed the complaint against the owner of the Jindal Crockery Store and directed the Khaitan company to replace the exhaust fan or refund the cost of the product to the complainant if a similar product was not available.
The forum also imposed a fine of Rs 2,200 for causing mental and physical agony to the complainant.
