The issuance of a no-objection certificate (NOC) for the transfer of lease rights will now take only 20 days as the Chandigarh Housing Board (CHB) has fixed a time frame for various services.
In a major step towards empowering people to seek hassle-free and time-bound service delivery mechanism, the board has fixed a time frame for services under the Punjab Right to Service Act, implemented on the directions of the Ministry of Home Affairs.
The mutation of property on the basis of a sale deed will take 20 days, conversion of leasehold units into freehold will take 30 days, the issuance of duplicate copies of the allotment letter, possession slip and physical possession will take 30 days, the issuance of a no-dues certificate will take 15 days, lump sum payment certificate will take 15 days, interest component certificate will take 15 days, the issuance of permission for mortgage of residential and commercial property and refund of money or other deposits will take 39 days.
Under the Act, besides fixing a time frame for the delivery of all services, the board has also nominated designated officers, first appellate authorities and second appellate authorities to decide appeals against delay in services. The Secretary of the board has been designated the first appellate authority, while the CEO has been designated the second appellate authority.
The Act also has provision for penalty on the designated officer for deficiency in service without any reasonable cause, which can range from Rs 500 to Rs 5,000. Besides, disciplinary proceedings can also be recommended.
The Administration has already constituted the Chandigarh Right to Service Commission. The commission will hear revision applications against orders of the second appellate authority. On failure to provide the service by the designated officer within the given time or refusal to provide the service, the aggrieved person can approach the first appellate authority.
