The Motor Accident Claims Tribunal (MACT) has awarded a total compensation of over Rs 44.99 lakh to be jointly and severally paid by offending car driver and New India Assurance Company Limited in a road accident case.
According to the case, on June 23, last year, at about 9.15 pm, deceased Inderjit Singh along with Lakhwinder Singh, alias Lakha, Sukhdev Singh, alias Ghuggi, Rahul Kumar and others was standing at the rehri of Jagtar Singh on Pattran Road, Samana. A car (HR22-G-2164) being driven in a rash and negligent manner on the wrong side of the road rammed into the egg rehri injuring those standing nearby.
However, Inderjit (48) and Rahul (20) suffered serious injuries and were shifted to a local hospital where they died.
The driver and owner of the car in its reply in the court stated the tyre of the car burst and the vehicle went out of control and the same was parked on the road side.
At that very time, another vehicle was coming from the opposite side, which ran over the deceased persons and the said vehicle did not stop and escaped after the accident. At that time it was dark and the registration number of the said vehicle could not be noted.
The insurance firm stated the liability of the company would arise only if the driver of the offending vehicle was holding a valid driving licence and the vehicle was being driven as per the provisions of the Motor Vehicles Act.In this case, District and Sessions Judge Balbir Singh ordered a compensation of Rs 31,68,420 to the family of Inderjit, a contractor, and Rs 13,31,000 to the dependents of Rahul, a labourer.
