Tribunal stays transfers within a month

The HP Administrative Tribunal has stayed the transfer of Sr Assistant serving in the office of Deputy Director Mandi who was transferred within just one month.
The bench of Himachal Pradesh State Administrative Tribunal comprising Justice VK Sharma, chairman, and Prem Kumar, member, administration, has directed the Secretary Education, Director, Higher Education, and Deputy Director (Higher Education) Mandi not to give affect to the transfer of the applicant till his representation was decided.
Pankaj was serving as Senior Assistant at Government Senior Secondary School (Girls), Sundernagar. After completing of his tenure he was transferred to the office of Deputy Director (Higher Education) Mandi as per order issued by the Education Department on October 28, 2016. He joined at the new office. But he was once again transferred to Senior Secondary School (Boys) on November 24 within just one month.
One Kashmir Singh was ordered to Government Senior Secondary School Randhara, (the distance of both these station was around 11 km). Sarita Devi, who was serving as Senior Assistant at Government Senior Secondary School Randhara, was posted in place of applicant.
The applicant has filed Original Application before the tribunal on the ground that the orders were issued to oblige the other respondent (Sarita Devi) who could have been conveniently posted at Senior Secondary School Mandi directly but instead of it the applicant was disturbed despite his short stay.
The tribunal, while disposing the matter, ordered that the applicant will make a detailed representation to the Director of Higher Education with the request for the cancellation of his order within seven days and the Director will decide the representation by December 31 in accordance with the transfer policy framed by the government of Himachal Pradesh.
It was further ordered that till the representation was decided by the Director Higher Education “further action in this regards shall be deferred”.
