Abetment to suicide: Petition of judicial magistrate dismissed

The high court has dismissed the petition filed by Judicial Magistrate Sidharth Sarpal for quashing of charges framed against him in an abetment of suicide case.
Justice Tarlok Singh Chauhan passed the order on a petition filed by Sidharth against the order of the Special Judge, Shimla, ordering the framing of charges against him under Sections 306 and 201 of the Indian Penal Code (IPC).
According to the prosecution, on a complaint of Sampuran Singh Kalmotia, an FIR was registered at the Shimla police station (West) on March 28, 2010.
The investigating agency alleged that the petitioner and the deceased girl were known to each other from school days and were in a relationship. Their relationship continued even after both of them got employed as judicial magistrate and lecturer, respectively.
They decided to get married to each other, which was not acceptable to the petitioner’’s parents who opposed the marriage on account of the non-matching of their horoscopes.
However, the petitioner continued to convince the victim and her parents that he would get married to her under all circumstances. But Sidharth got engaged to someone else.
The prosecution alleged that the victim, after knowing that Sidharth had got engaged, committed suicide.
While dismissing the petition, Justice Tarlok Singh Chauhan observed that Sidharth and the girl were not strangers and sufficient evidence was available which stated that both were in an intimate relationship.
