The court of Judicial Magistrate Shifa today directed the Central Board of Secondary Education (CBSE) to rectify an error in a student’s matriculation certificate wherein the mother’s name was mentioned wrongly.
Vipin Gupta, a resident of Sector 37 C, Chandigarh, and her daughter Kanika Mahajan filed a suit against the Regional Office, Central Board of Secondary Education, Sector 5, Panchkula (Haryana), and the Principal, Government Model High School, Sector 38 D, in the court after their efforts to get the name corrected from the CBSE bore no fruit.
As per the case, the petitioners sought relief of declaration to the effect that the actual name of Kanika’s mother be declared as Vipin Gupta and the CBSE as well as the Principal, Government Model High School, are directed to delete the name Aman in the matriculation certificate of her daughter.
It was stated that at the time of admission of her daughter, Vipin Gupta submitted her daughter’s birth certificate to the CBSE but at the time of Board examination, it was informed to the class teacher concerned that Aman was Vipin’s nickname and that her actual name was Vipin Gupta.
However, on the matriculation certificate of her daughter, her name was mentioned as Aman. The mother-daughter duo moved court after their persistent efforts for getting the error rectified failed.
The court ruled that the petitioner is entitled to declaration to the effect that her actual name be declared Vipin Gupta and also to the relief of mandatory injunction directing the defendants to mention the name Vipin Gupta in place of Aman in the matriculation certificate of her daughter.
