Forum tells firms to shell out Rs 10K

Consumer court has ordered four parties, including e-commerce firm HomeShop 18 and mobile phone manufacturer Spice, to return invoice price to a Sector 35 resident. The handset began to malfunction a few days after purchase.
District Consumer Disputes Redressal Forum-I in its judgment besides asking for refund of Rs 4,999, to complainant Jaswinder Singh, has also ordered to to pay Rs 5,000 as compensation for mental agony and harassment caused to the complainant, other than Rs 5,000 litigation cost.
Singh filed his complaint under Section 12 of the Consumer Protection Act, 1986, against four parties- Homeshop 18, North India Top Company (P) Ltd, Spice Retail Ltd and Vignesh Services.
He alleged that on November 9, 2014, he bought a Spice 5-inch Android Dual Core Phablet 508 mobile through online shopping from HomeShop 18.
According to the complainant he started facing problems with the handset as the display was not working properly. Singh complained to Homeshop 18, which referred the matter to Vignesh Services. However, it refused to redress his grievance.
The complainant also sent a legal notice alleging that these acts amount to deficiency in service and unfair trade practice.
Spice Retail Ltd averred the every handset carries limited warranty of one year against any manufacturing defects for which the buyer is required to approach the authorised service centre for replacement or repair. The court pronounced the order in the favour of the complainant.
