MACT awards Rs 12.27 lakh relief to victim’s family

In an accident case which claimed the life of a 23-year-old girl after a truck was parked in the middle of road and a speeding car hit the truck, the Motor Accident Claims Tribunal presided by ADJ RK Jain has ruled that both the truck and the car were at fault. Delivering a rare judgment, the MACT has ruled that both the truck and car owners, drivers of the car and the truck and both insurance companies are liable to pay to the victim’s family a compensation of Rs 12. 27 lakh.

As per the petition filed through Advocate Thakur Kartar Singh by the girl’s parents, the accident occurred December 21, 2012, when a 24-year-old girl, Neha Negi, who was a beautician residing in Dera Bassi was traveling from Ambala to Chandigarh in a Ford Fiego car along with her friends.

While she was seated in the Ford Fiego, it was driven by her friend Avinash Chand Arora.

As they reached near Dera Bassi, the driver of the car failed to intercept a truck parked in the middle of road as there was complete darkness and no parking lights were switched on. The car banged into the truck head on.

The victim, Neha Negi, died as she got critical injuries as an impact of the accident.

In court, both the truck driver as well as the car driver held each other responsible for the mishap.

The MACT ruled that both the truck driver as he parked the vehicle in the middle of the road and the car driver, who could have intercepted the truck had he been driving carefully, were at fault.

The MACT awarded that a sum of Rs 12.27 lakh be awarded as compensation to the aggrieved parents of the victim. 

It was ordered that the compensation amount be paid jointly by car driver Avinash Chand Arora, owner of car Parveen Kumar Goyal, truck driver Chand Singh, owner of the truck Ranveer singh, Royal Sunderam Aliance Insurance Company (in case of the car) and Reliance Insurance Company (in case of 

the truck).
