The UT Consumer Disputes Redressal forum headed by president Rajan Dewan, today issued non-bailable warrants against Amarjit Singh, MD and Uday Raj Singh, directors of M/s UK Homes Pvt Ltd, for non-compliance of orders dated January 21, 2015.

Earlier, Smriti Kaila of Sector 12-A, Panchkula, had filed a complaint alleging that in 2011, M/s UK Homes Pvt Ltd had taken Rs 1,00,000 as registration money, for the allotment of 200 sq yard plot. In December 2011, the company promised that possession of the plots would be given by June 2012 and took another payment of Rs 2,00,000, but no agreement was executed. When the complainant visited the site, there was no sign of any development. The complainant applied for refund on October 29, 2012.

The company directly deposited only Rs 2,30,000 in the bank account of the complainant, on August 24, 2013.

Pankaj Chandgothia, counsel for the complainant, contended that Rs70,000 was arbitrarily deducted by the company. The company could not have taken any amount without any project approval. He contended that the company had indulged in unfair trade practice.

The forum directed the company to refund the amount of Rs 70,000 to the complainant along with interest at the rate of 12 per cent per annum and to pay interest at the rate of 12 per cent per annum.

UK Homes was also directed to pay Rs 10,000 as compensation for the mental agony and harassment caused to the complainant and to pay Rs 7,000 as costs of litigation.

When the complainant did not get any refund, an execution petition was filed, in which a show-cause notice was issued to the directors of the company. Today, when no one appeared on behalf of the company directors, Chandgothia submitted that they were all liable to be summoned and punished as provided in Section 27 of the Consumer Protection Act, 1986.

The forum took note of the willful defiance of its orders and issued non-bailable warrants against the directors for October 28, 2015.
