The Central Administrative Tribunal (CAT) today asked the UT counsel to give an affidavit showing that they had released pensionary benefits to a retired Tehsildar in whose case it (the tribunal) had ordered attachment of the UT Deputy Commissioner’s salary.
The Punjab and Haryana High Court had later ordered a stay on the CAT order.
Today, the Administration, through its counsel, informed CAT that it has implemented the order regarding giving benefits to the Tehsildar. On this, the tribunal asked the respondent to submit an affidavit in this regard.
Earlier, CAT had ordered that the DC’s salary should not be released until the officer complies with its order within one month. A contempt application was filed against the officer in July for not complying with the directions of the tribunal.
In January, the tribunal had issued directions to release the applicant’s pensionary benefits — gratuity, commutation of pension and regular pension — along with interest thereon at the rate of 9 per cent per annum from the due date till payment.
The applicant retired in 2014 and then rendered post-retirement service for over nine months.
However, his pensionary benefits were not paid. The applicant was granted provisional pension, but it was also stopped during the pendency of the case.
