A local court today awarded the director of a Delhi-based company one-year jail term each in seven cheque-bounce cases and ordered him to pay the total cheque amount (Rs 95.46 lakh) as compensation to the complainant in the case. However, he was later bailed out by the court, enabling him to appeal further.
A criminal complaint was lodged by Sarabjit Singh, Manager, Him Teknoforge Limited, Sector 28, against Ryder Matic Bevel Gears Pvt Ltd, Delhi, and its directors Jyoti Kukreja, SK Kukreja and Pawan Kumar Chawla under Sections 138/142 of the Negotiable Instruments Act in 2012.
In the complaint, it was alleged that Jyoti and SK Kukreja projected themselves as the owners of a forging plant at Malaysia, weighing 1,500 tonnes, and having accessories. They claimed that it was free from encumbrances. They induced Sarabjit to purchase items from the plant for Rs 10.75 crore. The two accused received Rs 1 crore from the complainant as part of the payment. However, Sarabjit later came to know that the accused had sold major parts and the main machinery to some other party.
Sarabjit lodged seven cheque-bounce cases against the accused as the cheques given to him bounced.
“The company returned Rs 50 lakh in cash to the complainant. However, three cheques bounced. Taking into account four other cases, a total of Rs 95.46 lakh was to be paid to the complainant.
The court ordered a jail term of one year each in the seven cases to SK Kukreja and ordered him to pay the total cheque amount as compensation to the complainant. “The other two accused are proclaimed offenders in the case,” said Sarabjit’s advocate Harish Bhardwaj.
