A local court has declined a plea seeking stay on the promotion of Anil Kapoor’s upcoming movie ‘Veerey Di Wedding’.
A suit had been filed by Make My Day Entertainments through its proprietor Rajat Bakshi, a Rohtak-based filmmaker.
In the case that came up for hearing in the court of Civil Judge (Senior Division) Harish Goyal, the petitioner had stated that he had applied before the Indian Motion Pictures Producers Association (IMPPA) for the registration of his Hindi feature film’s title ‘Veerey Ki Wedding’ on June 7, 2016, and was allotted the said title eight days later.
The petitioner maintained that thereafter, he started making the movie with actors Jimmy Shergill, Pulkit Samrat, Supriya Karnik and Satish Kaushik.
On September 15, 2016, he got the title ‘Veerey Ki Wedding’ registered with the Trademark Registry of the Government of India under the category of Hindi cinematographic film without any hindrance or objection.
On March 4 this year, he applied for the renewal of the title of his said film and it was renewed by the IMPPA on May 2.
The petitioner said in April this year, Anil Kapoor Film Company Private Limited sent a Cease and Desist notice against the usage of the title ‘Veerey Ki Wedding’, claiming that they were the rightful registered owner of the title ‘Veerey Di Wedding’ for their upcoming Hindi feature film, starring Kareena Kapoor Khan and Sonam Kapoor etc.
In the notice, Anil Kapoor Film Company asked the petitioner to cease and desist from using the “deceptively similar” title of ‘Veerey Ki Wedding’.
Advocate Rakesh Sapra, who appeared in the court on behalf of Anil Kapoor Film Company, pointed out that the same controversy between the said parties was pending before the Bombay High Court.
“Prima facie, the controversy in matter is hit by Section 10 of the CPC. Moreover, till today, no release date of the film has been given by the defendants. So there is no urgency involved in the matter at this stage. Request for interim relief is declined,” the court of Civil Judge (Senior Division) ordered after hearing the versions of both sides.
The next hearing in the case has been fixed for October 26.
