After the city police gave a clean chit to the owner of Haveli restaurant Satish Jain against whom his brother Harish Jain had filed a complaint of committing fraud in the firm, now on the recommendation of the District Attorney Legal, proceedings under Section 182, IPC, were initiated against Harish.
Dev Dutt Sharma, ACP Central, Jalandhar, who had conducted a probe into the allegations, in his investigation report (the copy of which is with The Tribune) cleared that the allegations levelled by Harish against Satish were baseless and he could not produce any documents to support his claims. After giving a clean chit to Satish, he had recommended action against Harish under Section 182, IPC. The report was sent to the DA Legal for approval.
The DA Legal in the report has stated: “I have gone through the facts of this complaint and probe report of the ACP Central as well as other documents attached with the file. As per the recommendation and finding given by the probe officer, the present complaint moved by Harish has been found false. As such, necessary proceedings under Section 182, Indian Penal Code, may be initiated against him, if so approved.”
ACP Sharma confirmed that proceedings under Section 182, IPC, were initiated against Harish.
The Haveli restaurant of the region had got embroiled in a controversy as the younger brother Harish Jain levelled allegation against its owner Satish Jain and his CA Surinder Mahajan of committing fraud in the firm. Harish in a complaint submitted to the Police Division No. 4 stated that his brother had thrown him out of the business by forging papers and he had equal share in the restaurant, located on the Jalandhar-Phagwara highway. However, the elder brother Satish had said he had not resorted to any fraudulent practices and his brother had resigned as the director from the firm at his own will and had surrendered his share in 2007 and resigned from the post of director in 2011.
Complainant to move court
Complainant Harish Jain against whom proceedings under Section 182, Indian Penal Code, were initiated said: “The police has cleared the probe without verifying my signature on the resignation letter from the forensic lab. The ACP has also not got specimen of my signature to match with the resignation letter. I was also called only once by the inquiry officer and was not given chance to prove my case. We will also make a company secretary, Gautam Goel,a party who testified my signature. I hope I will get justice from the court now.”
