But if efforts are made, we can make the city encroachment free by ensuring that the goods on display on the pavements make their way back into the shops. Customers should park their vehicles on the side earmarked for the purpose. The traffic police should place the cones along the kerb of the road to prevent parking of vehicles. Also, yellow lines should be drawn on road sides to restrict street vendors from occupying spaces on the road. If these measures are taken on a continuous basis, we can make an encroachment-free carriage way and pavements in the city.

Vendors and hawkers of the city extend their shops to the pavements which lead to congestion on road as pedestrians are forced to walk along the road instead of pavements. The illegal sign boards, banners and advertising hoardings are also a cause of the same as these are mostly placed at a place where they can seek more attention. This often results in road accidents. The cases of falling down of banners and hoardings are also increasing day-by-day. To resolve the issue of encroachments, these cases need to be treated as a criminal offence. Laws related to banners and hoardings need to be strict. Municipal Corporation must take strict actions against the offenders with harsh punishment. The MC should demolish the temporary and permanent structures from pavements as soon as possible. They need to impose heavy fines on those who are responsible for congestion on road. Guidelines, regarding concerning issues, should be issued.

Problem of encroachment is posing a threat to the city. The Municipal Corporation has often conducted encroachment drives but the problem still persists. There must be stricter laws implemented so that the guilty does not repeat the offence. In markets, no shopkeeper should be allowed to extend his or establishment beyond a permissible limit prescribed under rules of the MC. There must be a separate provision of land or space for vendors and other hawkers to sell their products. Parking spaces should be provided to park scooters and other vehicles. Ludhiana is becoming a congested city day-by-day, and encroachment is the biggest cause of this problem. Encroachment is illegal confinement of someone else’s property. There are various markets in the city where business totally depends on encroachments. Some shopkeepers allow vendors and vegetable sellers to use the road in front of their shops and charge money from them for profit purposes. Encroachments cover huge area of the roads, which lead to traffic jams and hazardous accidents. These encroachments become extremely dangerous during festival season. Many a time, it can be easily seen that property owners, knowingly or unknowingly, increase the limits of their house and take possession of government property or neighbour’s property. They grow plants and make small parks in front of their houses on government property. In order to curb this difficulty, government should make strict laws and policies. Huge fines and penalties should be imposed. After giving due notices, these encroachments should be destroyed if owners don’t comply with the rules. Specific areas should be marked where encroachments can be allowed for lower level traders but entrance of vehicles should be strictly prohibited in those places. Make public aware of their property rights
Encroachments are of two types, temporary and permanent. Encroachers, encroaching upon government land, is a big problem, be it market places or any religious place. There is no doubt that this ill-practice goes on with impunity, which proves that even the local administration are hand in glove with the encroachers. The first and foremost duty of the local administration is to keep an eye on any type of encroachment in the city. If encroachment still takes place, then a legal notice under the Public Premises Act (PPA) should be served immediately to the concerned encroacher. If still the encroacher is adamant, then a court case should be filed against him/her in the court of the Sub-Divisional Magistrate for eviction. After obtaining eviction orders from the SDM, immediately the encroachment should be removed/demolished as the case may be with the help of the administration and the local police. In case of temporary encroachments, there should be confiscation of all articles kept on the encroached land. Nobody has any right to use public land for personal motives. These types of encroachments pose a serious threat to traffic and hassle-free movement of public. The only way to solve this problem is a strict, stern and immediate action upon the encroacher so that the others, who are in a look to encroach, should not dare to do so.

Every person has the right over his/her property, home and other assets. But in some cases, we have the common right to use public properties such as roads, bridges, dams, hospitals, parks and other public properties. Roads, pavements, streets, markets are encroached by shopkeepers and hawkers for other social or religious functions. This leads to traffic jams and inconvenience to commuters to move freely. Prime locations are encroached under the nose of local government. Sometimes government officials have to stop encroachment operation due to political interference. This may leads to inconvenience to others at the cost of one. There must be strict laws to handle with encroachers. Municipal Corporation should allocate separate space for hawkers. There must be regular visits to each area to check the activities of encroachment. Only then there will not be any building which will mushroom up in any area on public land. The Municipal Corporation must also establish a separate cell to receive complaints on line by residents against encroaches. Sudden visits must be carried on in different areas to check encroachment. The charge must be given to private agency to avoid the political interference as it is given in the case of tow away vehicle by traffic police. Heavy fine should be imposed upon encroacher. People should cooperate with the government to have free and hassle free movement of traffic and to avoid from traffic congestion. It is the moral duty of each and every citizen not to encroach any space of public or common property rather one should lend support government in this common cause. There must be banners placed on prime locations showing warnings and other penalties for those who will encroach and names of encroachers must be published on banners. Encroachers should not be given basic amenities such as water, sewage and electricity. Government should award to those who will bring into the notice of Municipal Corporation about encroachers. This is the moral responsibility of every resident not to encroach any part of public property.
