A day after the police issued a notice to the family of Rinkal Khera, a BJP supporter who was allegedly killed by the son of Congress councillor Jatinderpal Singh Sunny and his aides over old political rivalry, the deceased’s family on Tuesday moved court to seek stay on the police notice.

The hearing in the case will be held on Wednesday.

On Monday, the Police Department issued a notice to the family of Rinkal, asking them to cremate his body within 24 hours. In the notice, the department had stated that Rinkal was killed on July 19 and despite repeated notices by the police, the family has not cremated the body, and by doing so, they were disrespecting the body of the victim.

Through the notice, the Police Department had asked the family to cremate his body within 24 hours according to their religious beliefs.The 24-hour deadline was to end on Tuesday and the police had plans to cremate the body on Wednesday if the family did not budge.

Mani, deceased’s brother, said on Tuesday, he had filed a petition in the court to seek stay but due to the absence of investigation officer from the police side, the court deferred the hearing on his plea for tomorrow. Now in tomorrow’s hearing, he will urge the court to provide him stay so that the police could not cremate the body. ”We will request the court to stay the police notice, as the assailants who killed my brother are still at large. Until and unless they are arrested, our life is also at risk. We first want the police to nab the culprits,” Mani told The Tribune.

The DCP, Ashwani Kapur, said since the deceased’s kin moved the court, the police would wait for the court’s order before proceeding further.
