Delhi High Court removes cap on condom prices

New Delhi, July 10

The Delhi High Court today quashed government orders placing condoms under the price control mechanism. A Bench comprising Chief Justice G Rohini and Justice RS Endlaw set aside the November 2013 and July 10, 2014, orders of National Pharmaceutical Pricing Authority (NPPA), terming them as “illegal and unsustainable.”

The HC order came on the petitions of pharmaceutical giant Reckitt Benckiser (India) Pvt Ltd and another company challenging the cap on the price of male contraceptives. The companies had contended that condoms fell in the category of devices, not medicine, and as such were out of the ambit of price control mechanism meant for essential life-saving drugs. — TNS
