Twenty years after a non-commissioned officer (NCO) from the Military Intelligence was dismissed and awarded one-year rigorous imprisonment for his alleged involvement in irregularities in Army recruitments, the Armed Forces Tribunal (AFT) has granted him relief by allowing him pensionary and other related benefits.
In its order a few days ago, the AFT ruled while the findings of the summary court martial (SCM) were upheld, the sentence of dismissal from the service is modified and the petitioner shall be deemed to have been discharged from service from the date on which he would have earned pension and other post-retiral benefits.
The petitioner, Birender Kumar had been posted with a Liaison Unit and, among responsibilities, was tasked to watch irregularities in recruitments. In November 1994, a recruitment racket involving military officials and civilian touts was busted by the police in Agra.
