Maj Gen convicted for making false claim on disability pension

A Major General has been convicted by a general court martial (GCM) for making “fake claims and falsifying official documents” to claim disability pension. He has been awarded forfeiture of 10 years’ of past service.
The trial, presided by Lt Gen Milind Hemant Thakur from Army Headquarters with six other Generals as members, commenced at New Delhi on March 6 and concluded today, sources said. The GCM’s findings and sentence are subject to confirmation.
The officer, Maj Gen Debasish Roy, former head of the Army Education Corps, was tried on four charges under Sections 57 and 63 of the Army Act for falsifying official documents, making false declarations and acts prejudicial to good order and discipline. The court held him guilty of all four charges.
Sources said the officer met with a road accident in April 2010 and sustained fractures, following which he was medically downgraded. In November 2010, when he was a Colonel, he got himself medically upgraded by stating that he had no medical complaints so that he could be promoted to Brigadier. In 2015, he again got himself downgraded for the same injuries to avail disability pension.
To be considered for promotion to Major General, he got himself upgraded again. After serving as the Additional Director General Army Education in the Military Training Directorate for two years, he managed to get himself medically downgraded again.
Following scrutiny of medical records and instances of flip flop over medical category, a court of inquiry (COI) was ordered to investigate the matter.
