New Delhi, January 24
The SC on Thursday refused to stay the amended provisions of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989, but said it would take up petitions against the amendments along with the review petition filed by Centre against its verdict on misuse of the Act.
A Bench headed by Justice AK Sikri said the Centre’s petition seeking review of the top court’s March 20, 2018, judgment and petitions challenging the validity of the amended provisions of the SC/ST Act will be taken up together.
As the petitioners demanded that an appropriate Bench be set up to take up the matter, the court referred it to CJI Ranjan Gogoi for reconstitution of a Bench that comprised Justice UU Lalit as he was part of the Bench that passed the March 20, 2018, verdict.
In its March 20 verdict, the SC had said “in view of the acknowledged abuse of law of arrest in cases under the Atrocities Act, arrest of a public servant can only be after approval of the appointing authority and of a non-public servant after approval by the SSP, which may be granted in appropriate cases if considered necessary for reasons recorded”. — TNS
