Promotion case: UT refutes DSP Ram Gopal’s claims

In its reply to the Chandigarh bench of CAT in the case of promotion of UT police DSP Ram Gopal, the UT Administration stated that while the DSP does not fulfil all conditions for promotion, it does not have any policy for promotion of DSPs to the SP rank.
As per counsel Mukesh Kaushik, it was stated in the reply that there were only four posts for SP in the UT, which were reserved for IPS officers. Ram Gopal had claimed in his petition that the Punjab Police Service Rules could be adopted in this case. However, the UT stated that it did not adopt the 2006 amendment of the Act as claimed.
The reply also read that Ram Gopal was promoted in 2016 with effect from 2011 but with riders. It was stated that his promotion was already disputed by two colleagues, who claim to be senior to him and the case was pending in the tribunal. The meaning of ‘continuous service’ is also disputed in the HC. The decisions on these two have to be taken into account before deciding Ram Gopal’s case.
