HC issues notice for 450 days of leave encashment

The Punjab and Haryana High Court today put itself on notice on the administrative side on a petition filed by a retired special secretary seeking leave encashment for 450 days and not 300 days.

Justice Jitendra Chauhan of the High Court fixed the case for February next year for further consideration.

The notice came on a petition filed by Ram Lal Jindal through counsel Navneet Jindal. Appearing before the Bench, the counsel contended that the Punjab Government framed new extension rules on October 30, 2015.

Among other things, the government took away some benefits such as increment and promotions to employees on extension. It also amended a rule regarding payment of earned leave.

A government employee during his service could accumulate 450 days’ earned leave. Under the old rules of extension, payment for 300 days of earned leave was made.

However, the proviso restricting payment up to 300 days was not there in the amended rules of 2015. As such, the petitioner claimed the payment for 450 days of earned leave on attaining the age of 58.
