RERA fit for plaints against realtors: HC

The Punjab and Haryana High Court has made it cleat that the Real Estate Regulatory Authority (RERA) set up by the State of Punjab had ample powers to look into grievances of residents against private builders.
The developments took place on a petition filed by Bikramjeet Singh and other petitioners against the State of Punjab and other respondents. Residents of 39-West Colony, Phase I, Sector 122, Mohali, the petitioners had alleged that the private builder was acting in violation of the Punjab Apartment and Property Regulation Act, 1995. The petitioners had submitted that he had violated the master plan.
Taking up the matter, the Division Bench of the High Court, comprising Justice Surya Kant and Justice Hari Pal Verma, asserted: “We are informed that the Principal Secretary, Housing and Urban Development Department, Punjab, has been notified as the Real Estate Regulatory Authority… We are, thus, of the view that the authority is vested with ample statutory powers for redressal of petitioners’ grievances.”
Disposing of the writ petition, the Bench directed the Principal Secretary, Housing and Urban Development Department, to call for records with reference to the petitioners’ allegations.
He was asked to take appropriate decision after hearing both parties. For the purpose, the Bench set a four-month deadline from the date of receiving the order’s certified copy.
