THE Indian Opinion received this week announces an important decision of the full bench of the Supreme Court of Natal declaring that a certain bye-law of town Municipality to be illegal and ultra vires. On the authority of this bye-law, the Town council had declined to grant a laundry licence to an Indian because the locality was believed to be allocated to Europeans only. This sort of racial distinction was contrary to law and those who framed the bye-law were not careful. We are not aware of a similar case having arisen in India. Many of the rules under certain sections of Acts and bye-laws are framed and liable to be passed by the executive authorities without due consideration of the main principles of the Legislative enactment.
