Q.I was a member of HUF.  Our HUF had three members and various assets, including a residential house. HUF was partitioned and as a result of partition a residential house held by HUF came to my share.  My wife and I had adopted a child legally as we did not have any child.  My query is whether my adopted son will be able to inherit the residential house after us?

According to the provisions of the Hindu Succession Act 1956, in case both of you die intestate i.e. without making a Will, your adopted son will inherit the property.  However, in such a case it would be advisable to make Will in favour of the adopted son by you and your wife to avoid any problem for him in future.

Heirs for mutation of a house

Q. Who are heirs for mutation of a house? I live in this house with my mother and father. The house is in my mother's name and I have one sister, who is married. Can she ask for share from property?

Your mother has a right to make a Will in favour of any person. However, in case she chooses not to make a Will and dies intestate, the property in her name will be inherited by the sons and daughters (including the children of any predeceased son or daughter) and the husband. This is in accordance with the provisions of the Hindu Succession Act 1956.

On the basis of the facts given in the query in case your mother dies without making a Will, the house property will be inherited by you, your sister and your father who will be considered legal heirs of the deceased. The mutation in revenue records, therefore, would be made accordingly.
