Swati Sehgal, Judge, Fast Track Special Court, Chandigarh, has acquitted two persons in a three-year-old rape and abduction case after the police failed to prove charges against the accused.
As per the prosecution, the case was registered against the accused under Sections 363, 506, 366, 120-B and 376 of the IPC and Section 4 of the POCSO Act on a complaint of the victim, a minor girl, in 2017.
As per the complaint, one accused abducted the victim and took her to the house of the co-accused.
The accused were later arrested by the police. After investigation, the police submitted a challan against the accused in the court.
After finding prima facie case against the accused, the court framed the charges to which they pleaded not guilty. Public Prosecutor claimed that the victim was minor and the prosecution has proved the case against the accused.
PIP Singh and Aanchal Thakur, counsels of the accused, claimed that they were innocent and had been falsely implicated in the case. They argued that there were contradictions in the statements of the victim. The counsels said the prosecution had failed to prove charges against the accused.
After hearing the arguments and examining the witnesses, the court acquitted both accused of the offences registered against them.
