332 challans pending against its owner, court asks cops to seize scooter

Chandigarh, February 9

In a first of its kind case, Chief Judicial Magistrate Aman Inder Singh has ordered the Traffic Police to take a scooter in their custody after it was found that 332 challans for various traffic rule violations were pending against its owner.

The court also directed the Traffic Police to keep the scooter in the Traffic Lines and not to release it until all challans are cleared by its owner. Besides, the court issued a non-bailable warrant against the scooter owner after he left the court without paying fines. The matter came to notice after scooter owner Gurinder Singh visited the court for depositing a challan.

The court, in the order, said: “Gurinder Singh, the scooter’s owner, is present in the court. Vide separate summary proceedings, he has pleaded guilty, convicted and sentenced to pay a fine of Rs.2,000 qua the challan issued on February 8, 2024 under the Section 184 (dangerous driving) and Section 129 (without helmet). In default of payment of fine, the violator shall undergo simple imprisonment for 10 days.”

“Perusal of the record showed that there were 332 challans pending against the vehicle number CH01BY-4038. Accordingly, under the Section 20(2) of the Motor Vehicles Act, 1988, driving license of the violator is suspended and he is disqualified from holding any driving license to drive any class of vehicle, specified in his driving license, for six months. His driving license be taken in custody and endorsement on the same qua cancellation be made,” said the court.

Further, the court directed the Traffic Naib Court to take the scooter in its custody and deposit it in the Traffic Lines. The court said since the violator has left the court without paying fines, he was ordered to be summoned through non-bailable warrant of arrest on February 19.
