Rs 49L relief for kin of ex-servicemen who died in road mishap
The Motor Accident Claims Tribunal, Chandigarh, has directed an insurance company along with the driver and owner of a car to pay compensation of Rs 49.98 lakh to the wife, two children and parents of a person who died in an accident seven years ago.
Amandeep Kaur, a resident of Dhakoli, Punjab, and others had filed the claim petition under Section 166 of the Motor Vehicles Act, 1988, for claiming a compensation on account of the death of her husband Jaimal Singh in an accident
The claimants stated that on December 9, 2018, Jaimal was going on his motorcycle from the Zirakpur side towards Panchkula. A car hit him when he reached on a railway crossing bridge near City Palace. The car was being driven in a rash and negligent manner, it was alleged.
Jaimal fell on the road along with his motorcycle and received multiple injuries on vital parts of the body. He was rushed to the Government Medical College and Hospital, Sector 32, Chandigarh, where he succumbed to his injuries.
A FIR in connection with the accident was registered at the Dhakoli police station. The claimants stated that Jaimal was 37 years of age at the time of his death. He was an ex-serviceman and working as a security guard, earning Rs 40,000 per month. The claimants were fully dependent upon the income of the deceased.
After hearing the arguments, the tribunal directed the insurance company and the car driver and owner to pay Rs 49.98 lakh as compensation along with interest at the rate of 9% per annum from the date of the claim petition till its payment to the claimants.
