The Sector 26 Sabzi Mandi Arhtiya Association has decided to move the Punjab and Haryana High Court against the e-auction being held for allotment of shops at the new mandi in Sector 39.

The commission agents have stated that the auction should have been carried out according to the rules of the State Agriculture Marketing Board. The administration is following the Estate Rules.

Association president Brij Mohan said this was a ‘blind’ auction in which the land was taken on a freehold basis but it is being given on leasehold. The commission agents generate revenue and give it to the market committee. The land at the new location was bought by the administration from the same funds, but the auction is being done as per the Estate Rules, he added.

Actually, the administration is selling the site on a leasehold basis, which is being opposed from the beginning. Secondly, if the auction was done as per the State Agriculture Marketing Board rules, then the existing commission agents would have got shops on a no-profit-no-loss basis. Also, the shops could have been given on a freehold basis.

According to the commission agents, a petition will be filed in the High Court this week. Its main basis is that this auction should be done under the rules of the State Agriculture Marketing Board.

In anticipation of commission agents move, the UT Administration had filed a caveat in the High Court.

The administration has started the process of e-auction of 23 shops in Sector 39 mandi on March 3. The Sector 26 grain market will be shifted to the new site in Sector 39. The auction is being e conducted online and for the first time, it will be open to the general public.

In the first phase, 23 out of the proposed 92 SCO sites will be auctioned, as per the terms and conditions of the Chandigarh Estate Rules, 2007. Out of a total of 92 shops, the remaining units will be put up for auction in the second phase.

The Sector 26 mandi operates on 24 acres, whereas the new facility in Sector 39 is spread over 75 acres.

A piece of land measuring 75 acres in Sector 39 was acquired in 1990 and the site was allotted for the new mandi in 2002.
