Bail denied to ASI who took prisoner to Mohali restaurant after court date

A local court has dismissed the bail application of ASI Jasbir Singh, arrested in a case registered for taking a prisoner to a restaurant in Mohali for enjoyment after producing him in a district court here.

The police registered the case on May 1 under Section 7 of the PC Act and Section 120-B of the IPC at the police station, Sector 36, Chandigarh, on the complaint of Charanjit Singh Virk, DSP, Chandigarh.

In the complaint the DSP stated that they got information that on April 30 a prisoner, Davinder Gill, who was involved in many cases of fraud and cheating, was to be produced before the court of Chandigarh by ASI Jasbir Singh and Constable Sandeep Kumar in a government vehicle.

However, the ASI neither took the government vehicle, nor asked the constable to escort him. Rather he took the prisoner in his private vehicle and after producing him in the court, freed him to enjoy at Pyramid restaurant, Mohali, and in the evening he lodged him back in Burail Jail.

During investigation, Jasbir and Davinder were arrested. Their call details and location details were analysed. As per their locations, Davinder was at Pyramid restaurant while Jasbir was present in Sector 17, Chandigarh, at that time.

Counsel for the accused claimed that the accused had been falsely implicated in the case. He said there was no documentary evidence to prove Davinder’s guilt. However JP Singh, Public Prosecutor, opposed the bail application.

After hearing the arguments, the court said the allegations against the accused were grave and serious in nature. It said the applicant was seeking bail on account of false implication. In view of the facts and circumstances of the case, the present regular bail application moved by the accused, stands dismissed, it stated.
