Rajnish Garg, Additional District Judge, Chandigarh, has dismissed an appeal filed by the Chandigarh Municipal Corporation against a judgment passed by the trial court in favour of a Sector 15 resident Manoj Kumar.

The trial court in the judgment passed on September 2, 2019, had held Manoj entitled for allotment of site in the old book market in Sector 15. He had filed a suit for declaration to the effect that he was entitled for allotment of a site in the market under a scheme and also for directions to the administration to issue allotment letter and give physical possession of the site.

He said the Chandigarh Administration had framed a scheme for resettling the old book sellers as it required open space for the construction of a cycle track. The MC said Manoj’s name was not in the survey list. The trial court held him entitled for the allotment of site.
