Chandigarh motor tribunal awards Rs 6.48 lakh relief to Panchkula man in road accident case
Rahul of Panchkula’s Sector 20 became permanently disabled and was unable to work after the accident
The Motor Accident Claims Tribunal, Chandigarh, has directed an insurance company, a driver and a van owner to pay a Panchkula resident Rs 6.48 lakh in compensation for the injuries he suffered in an accident that rendered him disabled.
Rahul, a resident of Sector 20, Panchkula, in the claim petition filed under Section 166 of the Motor Vehicles Act, said that on December 21, 2018, he was going home on his motorcycle with two others when a van coming from the opposite direction hit the bike in Zirakpur.
They sustained injuries and were taken to the PGI, Chandigarh, by the van driver, but thereafter, he fled the scene.
A First Information Report under Sections 279, 337 and 427 of the IPC was lodged at Zirakpur police station.
In the accident, he suffered multiple fractures in his right leg, injuries on the head and a toe amputation, following which he became permanently disabled and was unable to work. He earned around Rs 20,000 a month as a labourer before the accident. He sought Rs 30 lakh, along with an annual interest rate of 12%, from the date of the accident, as compensation.
The driver and the owner of the van, however, denied the allegations and claimed that no such accident took place.
The Tribunal directed the insurance company and the owner and driver of the van to pay Rs 6.48 lakh to the complainant along with 7.5% interest from the date of filing of the claim petition.
