Decide plea against cracker ban, High Court tells Chandigarh

The Punjab and Haryana High Court today directed the UT Administration to decide a representation filed by the Chandigarh Cracker Dealers Association against the complete ban on the sale or use of crackers of any kind throughout the UT. For the purpose, the High Court gave the UT two days time.

The High Court Bench of Chief Justice Ravi Shanker Jha and Justice Arun Palli also granted the petitioner association the liberty to raise a claim of compensation by way of a civil suit. The association was seeking quashing of the order dated November 6 passed by the respondent Adviser to the Administrator by exercising powers mentioned under the Disaster Management Act, 2005, to impose the ban. The petitioner claimed “wholly erroneous considerations”.

Directions were also sought to pay compensation in lieu of the loss suffered by members of the petitioner association due to the sudden ban. — TNS
