Chandigarh DM to probe allegation of torture in police custody

A local court has directed a District Magistrate (DM), Chandigarh, to conduct an independent inquiry regarding the allegations of custodial torture made by Amar Singh, a resident of Kishangarh village, Chandigarh. The court has passed the order while allowing his bail application.
The accused was arrested on an FIR registered under Sections 323, 341 and 506 of the IPC and Sections 25, 54 and 59 of the Arms Act on June 18 at the IT Park, Chandigarh, police station.
The court in the bail order said except the offence under Sections 25, 54 and 59 of the Arms Act, all are bailable offences and recovery under the Arms Act had already been made from the accused. But when the accused was produced before the court, he alleged torture during police custody.
The court said it was pertinent to mention here that there were visible injury marks on the body of the accused and also there was a fracture on his right leg. Regarding the custodial torture, the court has already directed the SMO concerned to conduct a thorough medical examination of the accused and directed the District Magistrate to conduct an independent inquiry regarding the allegations of custodial torture.
The court said there were visible injury marks on the body of the accused and one of his legs was also fractured and for this he needed better medical treatment.
It further said the presentation of challan and conclusion of the trial should take a long time, therefore, there was no purpose of keeping the accused behind the bars as his guilt was yet to be proved. In view of this, the present bail application of the accused is allowed, subject to furnishing of bail bonds of Rs 50,000 with one surety of same amount, it added.

The court said that there were visible injury marks on the body of the accused and also there was a fracture on his right leg. Regarding the custodial torture allegation, the court has directed the SMO concerned to conduct a thorough medical examination of the accused.
