The Motor Accident Claims Tribunal, Chandigarh, has directed Haryana Roadways and an insurance company to pay compensation of Rs 16.44 lakh to parents of a person who died in the accident two years ago.
The claim petition has been filed by a woman, Pinky, and her husband, residents of Milap Nagar, Ambala Cantt, for seeking compensation for the death of their son Aayush Rana in an accident. She said on June 1, 2023, his son was returning home on his motorcycle after attending cricket coaching at the academy at MM University, Sadopur, Ambala.
He was driving at a moderate speed on the left-hand side of the Chandigarh-Ambala Cantt road. His friend, Arpit Verma, was riding pillion. Around 5.30 pm, when they reached the flyover at Baldev Nagar, Ambala, a Haryana Roadways bus was moving ahead of them. The driver of the bus suddenly swerved left and applied brakes abruptly, without any indication.
Consequently, the rear portion of the bus struck the front of Aayush’s motorcycle. Both fell on the roadside along with the motorcycle and sustained injuries. Arpit suffered minor injuries, while Aayush sustained multiple grievous injuries, including a severe head injury.
Aayush was taken to a hospital, where he was declared brought dead. She said that the accident occurred solely on account of rash and negligent driving by the driver of the bus. On the other hand the driver of the bus denied the allegations.
After hearing the arguments the tribunal said that the claimants were entitled for a compensation of Rs 16,44 lakh. The amount of compensation shall be paid jointly by Haryana Roadways and the insurance company. The mother will get 50% out of the total amount, father 25% and minor sister of the deceased 25% of the total amount.
