The Punjab and Haryana High Court has appointed former Chief Justice of the Sikkim High Court, Justice Permod Kohli, as sole arbitrator to resolve the issues between the municipal corporation of Chandigarh and Jaypee Associates regarding the functioning and taking over of the solid waste management garbage plant.
The High Court had earlier appointed its former Judge, Justice AL Bahri, as the arbitrator. But before the order could be signed, counsel for the parties apprised the court that Justice Bahri was not conducting arbitration proceedings now. “In view of the mutual agreement between the parties, Justice Permod Kohli, Chief Justice (retd), High Court of Sikkim, be appointed as arbitrator,” Justice BS Walia of the High Court asserted.
The order came on a petition filed by the municipal corporation. The matter was placed before the Justice Walia’s Bench after the corporation approached the High Court against an order passed by a UT court. Taking up the matter,
the court had stayed the corporation’s decision to take over the possession of the plant.
