MACT directs insurance company to Pay Rs 22.26 lakh compensation to deceased’s family
The Motor Accident Claims Tribunal (MACT) in Chandigarh has ordered an insurance company, a truck driver, and the vehicle’s owner to pay Rs 22,26,000 in compensation to the wife and two minor children of Mohan Yadav, who died in a tragic accident two years ago.
According to the claim petition filed by Sunita, Mohan Yadav’s wife, under Section 166 of the Motor Vehicles Act, 1988, he was working as a security guard and was travelling in a truck from Gajraula (UP) to Barnala (Punjab) when the accident occurred. The truck driver, Mohammad Iqbal, was driving at a high speed and collided with a dumper that had slowed down and was reversing. Mohan Yadav suffered fatal injuries and died later.
Sunita alleged that the accident was caused solely by the truck driver’s rash and negligent driving. She claimed compensation of Rs 50,00,000, along with interest at 24 per cent per annum from the date of filing the claim petition.
The insurance company contested the claim, arguing that the accident was caused by the negligence of the dumper driver, who was not a party to the case. However, the tribunal rejected this argument, stating that the insurance company failed to prove that the accident was caused by the dumper driver’s negligence.
The tribunal directed the insurance company to pay Rs 22,26,000 in compensation to the claimants, along with interest at 9 per cent per annum from the date of the claim petition.
