Chandigarh: MACT orders Rs 19L relief for kin of man who died in road mishap

Chandigarh, January 12

The Motor Accident Claims Tribunal (MACT), Chandigarh, has directed an insurance company and the driver and the owner of a car to pay Rs 19,40,500 to the wife, children and parents of a man who was killed in a mishap six years ago as compensation.

Rani Devi, a resident of Haryana’s Kaithal, had stated in a claim petition filed before the tribunal that her deceased husband, Mahinder Pal, was about 40 years old when he died. According to the claimant, her husband was a painter who used to make Rs 21,000 every month.

Was hit by speeding four-wheeler

• The victim was en route from his house in Kaithal’s Shakti Nagar to Tatiyana village of Pehowa tehsil on a bike when a speeding car slammed into the bike, knocking him off
• He sustained multiple grievous injuries on his head and breathed his last at Patiala’s Rajindra Hospital on August 30, 2018
• The driver and the owner of the car denied the charges and claimed that a false FIR had been registered by the police.

According to Devi, Pal and his father, Ramchander, were en route from their house in Kaithal’s Shakti Nagar to Tatiyana village of Pehowa tehsil on a bike when the tragedy struck.

At about 4:30 pm that day (August 18, 2018) in Cheeka Town, a speeding car slammed into them, knocking Pal off the motorcycle. He sustained multiple grievous injuries on his head and breathed his last at Patiala’s Rajindra Hospital on August 30, 2018.

The driver and the owner of the car denied the charges and claimed that a false FIR had been registered by the police. Further, the insurance firm questioned the locus standi of the claimants to file a petition. After hearing the arguments, the tribunal directed the owner and the driver of the car and the insurance company to pay Rs 19,40,500 to the claimants as compensation.
