No maintenance charges without occupation certificate, Mohali builder told

The State Consumer Disputes Redressal Commission here has directed a Mohali builder not to collect maintenance charges unless and until ‘complete occupation certificate’ is obtained from the competent authority concerned.
The commission has passed the order on a revision petition filed by M/s Singla Builders and Promoters Limited and Nxtep Maintain Infraz Pvt Ltd.
The petitioners had challenged the interim order dated December 11, 2023, passed by the District Consumer Disputes Redressal Commission-II, UT, on a complaint filed by a Mohali resident.
In the revised interim order the petitioners had been directed not to collect maintenance charges from any of the occupants, including the complainant, unless and until ‘complete occupation certificate’ is obtained from the authority concerned.
The state commission upheld the order with modification. It said the district commission erred in interpreting the findings given by the national commission in qua giving relief of non-payment of maintenance charges in the case to other occupants of the project, when it should have been passed in favour of the complainant only.
