Non-bailable warrants against estate developer

The Haryana State Consumer Dispute Redressal Commission here has issued non-bailable warrants against the managing director (MD) of Samar Estates, Vinod Bagai, for non-compliance of orders passed by the Commission, which mandated him to make payment to a flat buyer. The MD “failed” to give possession of the flat even after taking payment from the buyer several years ago.

Complainant’s counsel Kunal Kapoor argued that the order had not been complied with even after expiry of nine months. He firmly opposed the misuse of adjournments for one or the other reasons.

The Commission observed, “Keeping in view the conduct of the opposite parties/judgment debtors (Samar Estates), managing director Vinod Bagai is ordered to be summoned by non-bailable warrants returnable for 26.11.2020.” The panel also directed the Panchkula Police Commissioner to ensure the execution of warrants. — TNS
