Zirakpur resort told to refund Rs 1.09 lakh, pay Rs 15K relief

Chandigarh, July 10

The District Consumer Disputes Redressal Commission, Chandigarh, has directed proprietor of M/s Dream Palm Resort, Zirakpur, to pay Rs 15,000 compensation to a person for not refunding the booking amount of a marriage function. It also directed the proprietor to refund booking amount Rs 1.09 lakh along with interest (9% per annum) within 45 days to the complainant.

In a complaint filed before the commission, Raj Kumar Sharma of Zirakpur said he approached the resort management for booking its banquet hall, including catering services, etc. for the marriage function of his daughter fixed for February 6, 2022. The management asked him that for the booking of the banquet hall he had to pay some advance money.

Accordingly, he paid Rs 1.57 lakh on December 6, 2021, as advance booking amount. The total amount of the function was settled at Rs 6.50 lakh for 250 persons.

He said he visited the resort and found that the quality of food and decoration was not up to the mark. He requested the management to cancel the booking and refund the advance amount paid by him, but the latter lingered on with the matter on one pretext or the other.

On the other hand, the management of the resort claimed that the amount was not legally refundable. It claimed that in fact the complainant and his family members were fully satisfied after inspecting the venue and the arrangement, service and quality of food and he even signed the booking form showing all details for the function.

After hearing of the arguments the commission found the resort management guilty of the deficiency of services.
