Chandigarh, July 19

The CBI has told the court a fresh final report under Section 173 of the CrPC will be filed in connection with probe into the Sukhmanpreet Singh Sidhu, alias Sippy Sidhu, murder case.

This has been stated by CBI DSP Ravinder Kush in a two-page status report filed before Sukhdev Singh, Special Judicial Magistrate, CBI, Chandigarh, today. The court had earlier directed the CBI to file a fresh status report regarding further investigation.

The CBI said the investigation was on and after its completion, a fresh final report under Section 173 would be filed in court. In view of this, the CBI urged the court to decide the untraced report as per law in the interest of the case. However, on specific query of the court, Sippy’s brother Jasmanpreet Singh Sidhu, the complainant, said they would not withdraw the protest petition filed against the untraced report.

Jasmanpreet said while one accused had been arrested, they wanted other police officers, including then SHO of the Sector 26 police station, to face trial for alleged destruction of evidence at the initial stage of the investigation.

The complainants in the protest petition demanded the police officers responsible for the alleged destruction and tampering of evidence might be summoned to face trial for offences allegedly committed by them. Public prosecutor Narinder Singh appeared on behalf of the CBI.

Supply of record to Kalyani opposed

The CBI has opposed an application moved by prime accused Kalyani Singh for supply of relevant documents/records and witness statements recorded under Section 161, CrPC, relied upon by the CBI while submitting its untraced report. The CBI said Kalyani was not nominated for prosecution in the untraced report, hence was not entitled to get the record enclosed with the report. It claimed further investigation was still on. — TNS
