Parminder Singh (29) was convicted on the basis of the scientific evidence despite the fact that the complainant in the case had turned hostile.

In her police complaint, Lakshmi Devi of Sector 41 said on June 18 last year, a person riding a bike suddenly snatched her purse, which contained a mobile phone and Rs 700, at the market. She raised the alarm but the suspect fled from the spot.

A case under Sections 379-A and 201 of the Indian Penal Code was registered at the Sector 39 police station.

During the investigation, the police arrested the accused and presented a challan in the court. The court framed the charges to which the accused pleaded not guilty.

The defence counsel claimed that the accused was falsely implicated in the case and the complainant also turned hostile.

However, the public prosecutor presented scientific evidence to prove the case. He said the snatched mobile phone was put under surveillance and was found to be operated with a SIM card issued to the accused’s father. The phone was used on June 21, establishing that that accused was in its possession.

After hearing the arguments, the court ordered that the prosecution proved the charges against the accused. Accordingly, the accused was held guilty and convicted under Section 379-A and 201 of the IPC and sentenced to undergo rigorous imprisonment for five years.
