A local court has sentenced Manish Kumar, a resident of Punjab, to undergo three years rigorous imprisonment (RI) in a cheating case registered six years ago.
The police had registered the FIR against the accused on February 21, 2018, at the Sector 17, police station, under Sections 420 of the IPC on the complaint of Jaskirat Singh Dhillon, owner of a company, Alpha Travel House, Sector 17-B, Chandigarh.
Dhillon told the police that Manish had started working with their company in November 2016. On January 18, 2018, a person from TSC Private Limited came to their office demanding more than Rs 15 lakh from them on account of some cheques. But on checking their records, they did not find any such entries.
After investigating they came to know that Manish had forged some documents and had opened an account with the TSC Private Limited under the name of Alpha Forex Pvt. Ltd without Dhillon’s permission.
This was brought to the notice of the TSC Private Limited and prior to that also they had informed them that the account was not theirs and they would not be liable for any outstanding payments.
They also found that that Manish had taken cash in advance from several clients in the name of the company. They even found out that he was still still working for his old company while being in job here. He also misappropriated cheques and cash received from the parties without bringing these to the company’s notice.
After completion of the investigation, a challan was presented against the accused under Section 420 of the IPC in the court.
After hearing the arguments the court said it had already been proved by the prosecution that Manish had opened a fake account of Alpha Forex Ltd with TSC Private Limited using the documents of complainant Jaskirat Singh Dhillon.
He used to credit the payments from clients in his account. Transactions between Alpha Forex Pvt. Ltd. and TSC Pvt. Ltd. and amounts credited in the account of accused Manish have been proven.
The court further said the offence committed by him was grave in nature, for which a lenient view could not be taken. As such, the convict was sentenced to undergo three years rigorous imprisonment The court also imposed a fine of Rs 2,000 on him.
