A local court has acquitted two accused in a rape case registered against them seven years ago after the prosecution failed to prove the charges.

The police had registered the case against three accused, Baljit Chaudhray, a former student leader, Harminder Singh, alias Motu, and Bhavjeet Singh Gill, under Sections 323 and 376-D of the Indian Penal Code on the complaint of a woman. While Baljit and Harmnider have been acquitted, Bhavjeet Singh Gill had been declared a proclaimed offender during the trial.

According to the complainant, who is a model, she and her friend resided in a flat in Sector 63. On November 10, 2018, a person, who is known to her, along with his two friends, came to her flat. One of them persons was allegedly carrying a pistol and began beating her up before assaulting her.

The woman said she called the Police Control Room. After registering a case against the accused at the Sector 49 police station, a statement was recorded.

Upon the completion of investigation, a challan under sections 323 and 376-D & Sections 25, 54 and 59 of the Arms Act was presented against the accused before the court. Finding prima facie case charges were framed against the accused to which they pleaded not guilty.

The public prosecutor argued that the prosecution has proved the case beyond a shadow of doubt, while the counsel of the accused argued that the accused were falsely implicated. He said the complainant has also not supported the case of the prosecution

After hearing the arguments, the court said the woman while appearing as witness told the court that she had developed consensual relations with accused persons. The prosecutrix was declared hostile and the court said that she has entirely disowned the prosecution version regarding the rape committed by the accused persons upon her before aquitting the accused.
